Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Collector Xchange LLC, doing business as The Collector Xchange ("we," "us," the "Site"). By creating an account or otherwise using the Site, you agree to these Terms. If you don't agree, don't use the Site. See also our Privacy Policy, which is part of this agreement.

You must be at least 18 years old and able to form a binding contract to use the Site. You must provide accurate information when you register — including a real photo of yourself — and keep it up to date. You're responsible for everything that happens under your account, including actions by anyone you share your login with.

The Site is a venue where collectors list, browse, message about, and arrange sales or trades of items with each other. The contract for any sale or trade is between you and the other user — we are not a party to it, we do not take title to items listed, and we do not act as a broker, appraiser, or authenticator. We don't verify that a listing is accurately described, that an item is authentic or graded as claimed, or that either party will follow through. The rating, review, and reporting features exist to help you make informed decisions and to let us act on bad-faith behavior — they are not a guarantee of any transaction's outcome.

Payments on the Site are currently simulated for demonstration purposes — no real money moves through the Site's payment flow, and we don't process real payment card or bank information. If you and another user arrange real payment for a sale or trade (in person, by cash, or through an outside payment service), that exchange happens entirely outside the Site and at your own risk. We are not responsible for it, and it is not covered by anything the Site tracks or displays. Exercise the same caution you would in any transaction with a stranger.

You agree not to:

• Misrepresent an item's condition, authenticity, grading, or origin.
• List counterfeit, stolen, or illegal items.
• Provide false identity, contact, or address information.
• Harass, threaten, or defraud another user.
• Upload photos or content you don't have the rights to use.
• Attempt to circumvent the Site's trade/order flow to avoid our trust and safety features (e.g. moving a transaction off-platform specifically to hide bad-faith conduct from ratings and reports).
• Use the Site for anything unlawful, or interfere with its normal operation (e.g. scraping, creating accounts with someone else's photo, or disrupting other users).

Violating these Terms can result in a warning, listing removal, or account suspension/termination (temporary or permanent), at our discretion, as reflected in your account status.

You keep ownership of the listings, photos, descriptions, messages, and other content you post. By posting it, you give us a non-exclusive, worldwide license to host, display, and distribute it as needed to operate the Site (for example, showing your listing photos to other users). You're responsible for having the rights to everything you upload.

We may remove content that violates these Terms or that we're required to remove by law, and we may disclose content or account information if required by law or to protect the rights, safety, or property of the Site or its users.

The Site does not charge any fees for listing, selling, or trading. If that changes, we'll post updated fee terms here before any fee takes effect for new activity.

Card Scan Access is an optional, paid add-on that automatically suggests card details from a photo when you add an item. It costs $19 per month or $39 per year, billed in advance, at the price shown at checkout.

This subscription renews automatically at the end of each billing period — monthly or annually, depending on the plan you choose — at the then-current price, using the payment method on file, until you cancel. By subscribing, you authorize us (through our payment processor, Stripe) to charge that payment method on each renewal.

You can cancel anytime from Account → Card Scan Access → Manage subscription. Cancellation takes effect at the end of your current billing period — you keep access until then, and we don't charge you again after that. We don't provide prorated or partial-period refunds for a cancellation mid-period. If a renewal payment fails, we (or Stripe, on our behalf) may retry it and will suspend access if it continues to fail.

We may change the price of this subscription going forward; any price change will apply starting with your next renewal after we've given you notice of it, not to a period you've already paid for.

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Site will be uninterrupted, secure, or error-free, or that any listing, user, or transaction is safe, legal, or as described.

To the fullest extent permitted by law, Collector Xchange LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of goods, money, or data, arising from your use of the Site or any transaction with another user — including a trade or sale that goes wrong, an inaccurately described item, or a payment arranged outside the Site. Our total liability for any claim relating to the Site will not exceed $100.

You agree to defend, indemnify, and hold Collector Xchange LLC harmless from any claim or demand (including reasonable legal fees) arising from your use of the Site, your content, your violation of these Terms, or your transactions with other users.

Please read this section carefully — it affects your legal rights. Any dispute between you and Collector Xchange LLC arising from these Terms or your use of the Site will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. This does not apply to disputes between you and another user over a listing, trade, or sale — those aren't covered by this clause and are handled through the Site's rating/reporting features or, if needed, independently by the parties involved.

You and Collector Xchange LLC each waive the right to a jury trial and to participate in a class action. Arbitration will be conducted by a neutral arbitrator under a recognized arbitration organization's rules, and judgment on the award may be entered in any court with jurisdiction. If any part of this arbitration clause is found unenforceable, the rest still applies, except that the class-action waiver may not be severed from an otherwise-applicable arbitration requirement.

These Terms are governed by the laws of Colorado, without regard to conflict-of-law rules, except where the Federal Arbitration Act applies to the arbitration clause above.

We may update these Terms as the Site changes. If we make a material change, we'll update the "Last updated" date above and, where practical, call it out more prominently. Continuing to use the Site after an update means you accept the revised Terms.
